Nonconsensual Dissemination of Sexual Images. Misdemeanor.

 

Title:  Oklahoma Statutes Section 1040.13b of Title 21

 

Status: In effect, as of May 5th, 2016

 

A person commits nonconsensual dissemination of private sexual images when he or she:

Intentionally disseminated an image of another person over 18, that is identifiable in the image or from information displayed with it, and is intimately exposed or engaged in a sexual act
Disseminates the image with intent to harass, intimidate or coerce the person, or when a reasonable person would know or understand that dissemination of the image would cause those things to happen.
Obtains the image when there’s reasonable understanding that the image was to remain private
Knows or a reasonable person should have known that the person in the image has not consented to the dissemination.

 

Repercussions: Any person who violates this shall be guilty of a misdemeanor punishable by imprisonment in county jail for not more than one year or by a fine of not more than $1,000, or both.

 

Does not apply to: lawful practices of law enforcement, prosecutorial agency functions, reporting criminal offenses, court or judicial proceedings, lawful medical practices and procedures, and images portrayed in lawful commercial settings.
