Disclosure of private images, class H felony – class 1 misdemeanor if under age 18

 

Title: General statuses Section 14-190.5A Disclosure of Private Images

 

Status: In effect, as of 2015

 

A person is guilty of disclosure of private images if all the following apply:

The person knowingly discloses an image of another person with intent to either:
o Coerce, harass, intimidate, demean, humiliate, or cause financial loss to the depicted person.
o Cause others to coerce, harass, intimidate, demean, humiliate or cause financial loss to the depicted person.
The depicted person is identifiable from the image or included information about it
The depicted person’s intimate parts are exposed or they are engaged in sexual conduct in the image
The person discloses the image without consent of the depicted person
The person discloses the image under circumstances that the person should have known there was a reasonable expectation of privacy

 

Repercussions: A violation will result in a Class H felony if the person is 18 years of age or older at the time of the offense. A violation will result in a Class 1 Misdemeanor for a first offense by a person who is under 18 years of age at the time of the offense. Second time or subsequent offenses by a person who it under 18 results in a Class H felony.

 

Does not apply to: images involving voluntary public exposure, disclosures made in the public interest, and providers of an interactive computer service.
