New York City Revenge Porn Law

 

Unlawful disclosure of an intimate image – misdemeanor

 

Title: Prohibiting certain disclosures of intimate images.

 

Subtitle: A Local Law to amend the administrative code of the city of New York, in relation to prohibiting certain disclosures of intimate images

 

Status: Enacted by the committee of public safety 12/17/2017

 

It is unlawful to disclose an intimate image, without the depicted individual’s consent, with the intent to cause economic, physical or substantial emotional harm to such depicted individual, where such depicted individual is or would be identifiable to another individual either from the intimate image or from the circumstances under which such image is disclosed.

 

It is also unlawful for a covered recipient to make a threat to disclose an intimate image, provided that the depicted individual is identifiable.

 

Repercussions: Criminal penalty — misdemeanor punishable by up to 1 year in jail, or a fine of up to $1,000, or both. And a civil cause of action for any relief expenses.

 

Does not apply to: threats or disclosures made in reporting unlawful activities, legal proceedings, law enforcement in the conduct of their duties, or providers of interactive computer services.
