Nonconsensual dissemination of private sexual images. Felony.

 

Title: NH Rev Sat 644:9-a Nonconsensual Dissemination of Private Sexual Images.

 

Status: in effect, as of July 2016

 

A person commits nonconsensual dissemination of private sexual images when he or she with intent to harass, intimidate, threated, or coerce the depicted person, disseminates an image of such person who is:

Identifiable in the image or information posted with it
Intimately exposed in whole or part or engaged in a sexual act

And the images were obtained during a time of reasonable understanding of privacy with knowledge that the person depicted did not consent to the dissemination.

 

Repercussions: Any person who commits the crime of nonconsensual dissemination of private sexual images shall be guilty of a class B felony.

 

Does not apply to: Disseminations made for lawful criminal investigations, reporting unlawful conduct, images involving voluntary public or commercial exposure, service lawful public purposes, and when in compliance with a subpoena or court order.
