Title: Enrolled senate Bill No. 508 sec 145e and 145f
Status: In effect, as of 2016
A person shall not intentionally and with the intent to threaten, coerce, or intimidate disseminate any sexually explicit visual material of another person if:
– The other person is at least 18 years old
– The other person is identifiable from the material itself or information displayed about the material. (does not apply if the identifying information is supplied by a third party)
– The person obtains the sexually explicit material under a circumstance where there were reasonable expectations of privacy
– The person reasonably should know that the other person did not consent to the dissemination of the material.
Repercussions:
– First violation- misdemeanor punishable by imprisonment up to 93 days or a fine of $500, or both.
– Second or subsequent violation– misdemeanor punishable by imprisonment up to 1 year or a fine of $1,000, or both.
Does not apply to:
– Images captured in an interactive computer service
– If the material is part of a news report or public artistic/expressive work
– A law enforcement officer, corrections officer in a correctional facility or jail engages in official performance of their duties
– A person reporting a crime containing said material
