Michigan Revenge Porn Laws

 

Title: Enrolled senate Bill No. 508 sec 145e and 145f

 

Status: In effect, as of 2016

 

A person shall not intentionally and with the intent to threaten, coerce, or intimidate disseminate any sexually explicit visual material of another person if:

The other person is at least 18 years old
The other person is identifiable from the material itself or information displayed about the material. (does not apply if the identifying information is supplied by a third party)
The person obtains the sexually explicit material under a circumstance where there were reasonable expectations of privacy
The person reasonably should know that the other person did not consent to the dissemination of the material.

 

Repercussions:

First violation- misdemeanor punishable by imprisonment up to 93 days or a fine of $500, or both.
Second or subsequent violationmisdemeanor punishable by imprisonment up to 1 year or a fine of $1,000, or both.

 

Does not apply to:

Images captured in an interactive computer service
If the material is part of a news report or public artistic/expressive work
A law enforcement officer, corrections officer in a correctional facility or jail engages in official performance of their duties
A person reporting a crime containing said material
