Title: KS HB 2501
Subtitle: “An act concerning crimes, punishment and criminal procedure; creating the crimes of unlawful transmission of a visual depiction of a child and unlawful possession of a visual depiction of a child; relating to blackmail; breach of privacy; jurisdiction and venue; crime committed with an electronic device; prohibiting offender registration for certain crimes.”

Breach of privacy is knowingly and without lawful authority disseminating any videotape, photograph, film or image of an- other identifiable person 18 years of age or older who is nude or engaged in sexual activity and when such identifiable person had a reasonable expectation of privacy, with the intent to harass, threaten or intimidate such identifiable person, and such identifiable person did not consent to such dissemination.
Repercussions: Breach of Privacy as defines above is a severity level 8, person felony and a severity level 5, person felony upon a second or subsequent conviction within the previous five years.
