Summary: It is unlawful for a person to intentionally disclose an image of another person who is
- identifiable from the image itself or from information displayed about the image if the person is nude and/or engaged in sexual activities
- the person has a reasonable expectation of privacy for that image
- the image is meant to harm, harass, intimidate, threaten or coerce the depicted person
Repercussions:
- class 4 felony if the image is disclosed by electronic means
- class 1 misdemeanor if a person threatens to but does not disclose an image that would be a violation.
Does not apply to:
- reporting unlawful conduct
- lawful or criminal reporting, legal proceedings or medical treatment
- images for commercial use or voluntary exposure in a public setting
- the reporting of anything under 47 United States Code section 230(f)(2) “Protection for private blocking and screening of offensive material”
- images disclosed with the consent of the depicted person
